Terms of Service

These terms, together with our Privacy Policy, form the entire agreement between you and Polat GmbH regarding your use of the Service. If you do not agree to these terms, do not use the Service.

Dealwise24 lets you paste a property or vehicle listing URL and receive an AI-generated report containing scores, market and neighborhood insights, and recommendations, based on data extracted from the listing and from third-party and AI-generated sources. The Service is an informational tool intended to support your own research — it does not conduct a survey, valuation, inspection, or legal check of any property or vehicle, and does not replace independent professional due diligence (see Section 10).

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Service.

• You must provide accurate, current information when registering, and keep it up to date.
• You are responsible for keeping your password confidential and for all activity that occurs under your account. Notify us immediately at support@dealwise24.com if you suspect unauthorized use of your account.
• You may delete your account at any time from your account settings, or by contacting us. Section 5 explains what happens to unused credits.

• The Service is offered on a pay-as-you-go basis using "Listing Checks" (credits), sold in one-time packs as described on our pricing page. Credit packs are one-time purchases, not subscriptions — we do not charge you recurring fees.
• Credits do not expire and stack across purchases. One credit is deducted per successfully completed report; if a report fails to generate, no credit is deducted and you may retry at no extra cost.
• All payments are processed by Stripe. We do not store your full card details. Prices are shown inclusive or exclusive of VAT as displayed at checkout, depending on your location.
• Except where required by Section 6 or by mandatory consumer law, credit purchases are non-refundable once a credit has been used to generate a report. Unused credits remain in your account for as long as your account exists.

If you are a consumer in the EU or UK, you generally have a 14-day right to withdraw from a distance contract for digital content or services without giving a reason, under the EU Consumer Rights Directive (2011/83/EU) and the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Because generating a report consumes a credit immediately and irreversibly, by clicking "Analyze" on a listing you expressly request that we begin performance immediately, and you acknowledge that you lose your right of withdrawal for that credit once the report has been generated. Any credits you have not yet used to generate a report remain covered by the 14-day withdrawal right, and you may request a refund for unused credits within 14 days of purchase by contacting support@dealwise24.com.

You agree not to:

• Use the Service for any unlawful purpose, or in a way that infringes the rights of any third party;
• Attempt to circumvent credit limits, rate limits, or security controls, or access the Service using automated means (bots, scrapers) except through any API we officially provide;
• Reverse engineer, decompile, or attempt to extract the source code of the Service, except to the extent this restriction is not permitted by mandatory law;
• Resell, sublicense, or provide access to the Service to third parties without our prior written consent; or
• Submit listing URLs or content you do not have the right to submit, or use reports we generate in a way that violates the terms of the original listing portal.

We may suspend or terminate accounts that violate this section, as described in Section 13.

Listing data, photos, and descriptions we display originate from third-party property and vehicle portals and remain the property of their respective owners. We are not affiliated with, and do not act on behalf of, those portals or the sellers or agents listed on them. You are responsible for complying with the terms of use of any third-party portal you interact with via the Service.

The Service, including its design, software, text, and the Dealwise24 name and logo, is owned by Polat GmbH or its licensors and is protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal or internal business use. You retain ownership of any content you submit (such as listing URLs), and you grant us a license to process it solely to provide the Service to you.

The Service does not provide financial, investment, legal, tax, or real estate advice, and no score, recommendation, or output of the Service should be relied upon as such. Scores and recommendations are generated using automated models and artificial intelligence based on data that may be incomplete, outdated, or inaccurate, and may themselves contain errors. They are provided for general informational purposes only, to support — not replace — your own independent research, including a professional survey, valuation, legal check, and financial advice appropriate to your decision. You are solely responsible for any decision you make in reliance on the Service.

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any report will be accurate or complete. This section does not affect any statutory guarantee or warranty that cannot lawfully be excluded under German, EU, or UK consumer protection law.

To the fullest extent permitted by law, our total liability to you arising out of or relating to the Service, whether in contract, tort, or otherwise, is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim, and we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or willful misconduct, for any liability under mandatory product liability law, or for any other liability that cannot lawfully be excluded or limited.

We may suspend or terminate your access to the Service if you breach these terms, if we reasonably suspect fraud or abuse, or if required by law. Where reasonably possible, we will give you notice first. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination (including Sections 9 through 12 and 15) remain in effect after termination.

We may update the Service and these terms from time to time. If we make material changes to these terms, we will notify you by email or through a notice on the Service at least 14 days before the change takes effect. Continuing to use the Service after a change takes effect constitutes acceptance of the updated terms; if you do not agree, you may stop using the Service and close your account before the change takes effect.

These terms are governed by the laws of Germany, without regard to its conflict-of-law principles. If you are a consumer, this choice of law does not deprive you of the protection of any mandatory consumer protection provisions of the country in which you are resident. Subject to mandatory consumer protection law giving you the right to bring proceedings in your own country, the courts of the courts of Berlin, Germany have exclusive jurisdiction over any dispute arising from these terms.

The European Commission provides a platform for online dispute resolution (ODR), available at ec.europa.eu/consumers/odr. We are not obliged, and do not currently agree, to participate in dispute resolution proceedings before a consumer arbitration board, but you are welcome to contact us directly first — most issues can be resolved quickly that way.

If any provision of these terms is found unenforceable, the remaining provisions remain in full effect, and the unenforceable provision will be replaced with an enforceable provision that most closely reflects its original intent. Our failure to enforce any provision is not a waiver of it. You may not assign these terms without our consent; we may assign these terms in connection with a merger, acquisition, or sale of assets.
